The minimum order is € 20, net of goods, excluding VAT.


Availability of products

All the products you find on our site can be ordered and already available in our warehouse.
Before each shipment, each product is opened and carefully checked, except in cases specifically indicated.
If the product is not available due to an inventory error or a simultaneous order, or if our verification proves damaged or incomplete, we will promptly inform you. At the same time your payment will be canceled and refunded in full.

Legal guarantee


All products sold on the Site are covered by the legal guarantee of conformity provided for in articles 128-135 of the Consumer Code ("Legal Guarantee").

To whom it applies

The Legal Guarantee is reserved for consumers. It therefore finds application only if you made the purchase on the lafataeildrago.com site ("Site") for purposes unrelated to your business, commercial, craft or professional activity that may be carried out. For those who have purchased on the Site and who do not have the quality of consumers, the guarantee for defects of the thing sold will be applied, the guarantee for the lack of promised and essential quality and the other guarantees provided by the civil code with the relative terms, forfeiture and limitations.

When to apply

The seller (and, therefore, as regards the purchases made on the Site, la Fata & il Drago di Gennari Niccolò, with registered office in 30028 Bibione (VE), Viale Aurora 33, VAT number: 03600950277) is responsible towards the consumer for any lack of conformity existing at the time of delivery of the product and occurring within two years of such delivery. The lack of conformity must be reported to the seller, under penalty of forfeiture of the guarantee, within two months from the date on which it was discovered.

Unless proven otherwise, it is assumed that the lack of conformity that occurs within six months of delivery of the product already existed on that date, unless this hypothesis is incompatible with the nature of the product or with the nature of the lack of conformity. From the seventh month following the delivery of the product, it will instead be your responsibility to prove that the lack of conformity already existed at the time of delivery of the same.

In order to take advantage of the Legal Guarantee, you must first provide proof of the date of purchase and delivery of the goods. Therefore, for the purpose of this test, you should keep the order confirmation e-mail or the purchase invoice, if requested, or the transport document or any other document that can attest to the date of execution. of the purchase (e.g. credit card statement or bank account statement) and delivery.

What is the lack of conformity

A lack of conformity occurs when the purchased good:

  1. it is not suitable for the use for which goods of the same type are usually used;
  2. it does not comply with the description made by the seller and does not possess the qualities of the good that the seller presented to the consumer as a sample or model;
  3. does not present the usual qualities and services of an asset of the same type, which the consumer can reasonably expect, also taking into account the declarations made in advertising or in the labeling;
  4. it is not suitable for the particular use desired by the consumer and which was brought to the attention of the seller at the time of the conclusion of the contract and which the seller has accepted.

Any failures or malfunctions caused by accidental events or by your responsibility or by a use of the product that does not comply with its intended use and / or with what is provided in the technical documentation attached to the product are therefore excluded from the scope of the Legal Guarantee.

Remedies available to the user

In case of lack of conformity duly reported in the terms, you have the right:

- primarily, to the free repair or replacement of the good, at your choice, unless the requested remedy is objectively impossible or excessively expensive compared to the other;

- in a secondary way (in the event that the repair or replacement is impossible or excessively expensive or the repair or replacement has not been carried out within reasonable terms or the repair or replacement previously carried out has caused significant inconvenience to the consumer) to the reduction the price or termination of the contract, of your choice.

The remedy requested is excessively burdensome if it imposes unreasonable costs on the seller in comparison with the alternative remedies that can be experienced, taking into account (i) the value that the good would have if there were no lack of conformity; (ii) the extent of the lack of conformity; (iii) the possibility that the alternative remedy can be tried without significant inconvenience for the consumer.

What to do in the presence of a lack of conformity

Alternative dispute resolution


ALTERNATIVE DISPUTE RESOLUTION (ADR) / ONLINE DISPUTE RESOLUTION (ODR)

We remind you that, if you are a consumer and you have lodged a complaint relating to a contract concluded with  la Fata & il Drago through this site, but it was not possible to resolve the dispute that is the subject of the complaint, Fata & il Drago will provide you with the information in regarding the body or bodies of Alternative Dispute Resolution for the out-of-court resolution of disputes (so-called ADR bodies, as indicated in articles 141-bis and following of the Consumer Code), specifying whether or not it makes use of these bodies to resolve the dispute itself.

Furthermore, we remind you that a European platform for the online resolution of consumer disputes (so-called ODR platform) has been established. The ODR platform is available at the following address http://ec.europa.eu/consumers/odr/; through the ODR platform you can consult the list of ADR entities, find the link to the site of each of them and start an online dispute resolution procedure in which you are involved.

Finally, according to art. 49 c. 1 letter v of the Consumer Code, if you intend to resolve a dispute born with the merchant you can use the Joint Conciliation procedure. The procedure can be started if after submitting a complaint to La Fata & il Drago, within 45 days, you have not received a response or you have received a response that you do not consider satisfactory. In any case, whatever the outcome of the out-of-court settlement procedure of the dispute, your rights to apply to the ordinary judge are reserved, and, if the conditions are met, to promote an out-of-court resolution of disputes relating to consumer relations through use of the procedures referred to in Part V, Title II-bis of the Consumer Code.
